POSSESSION OF ASSAULT WEAPON - Charges Dismissed
May 2024
Client had a valid Massachusetts LTC. On one evening Client had a medical emergency and the police were called to his residence. While lawfully inside the residence, the police observed in plain view that his registered firearms were not stored properly. The Police also found several unregistered weapons, including rifles and a 3D printed handgun, located in different areas within the residence. The Holbrook Police sought and were granted a criminal complaint against the defendant charging him with 10 different counts. The district attorney's office initially wanted to indict the Client on the criminal charges, however, after significant negotiations the Commonwealth kept the case in District Court. Attorney Flaherty drafted but did not argue a Motion to Suppress. Attorney Flaherty was able to get 9 of the 10 counts dismissed. The final single count, alleging improper storage of a firearm, was eventually dismissed after 9 months.
