ASSAULT WITH FIREARM CHARGES DISMISSED PRIOR TO ARRAIGNMENT

Client was a Federal employee with a valid Massachusetts License to Carry (LTC). He was involved in a road rage incident where the other driver (half his age) exited his vehicle, started yelling and acting erratic, and aggressively approached Client' vehicle (his wife was a passenger in the vehicle). In response, the Client exited his vehicle and, in an effort to de-escalate the situation, showed the other driver that he armed with a firearm. The other driver then fled the scene but later called the police, alleging Client pointed the gun at him. Attorney Flaherty meet with the Client and assisted him with being interviewed by the police. The police decided not to arrest the Client but instead summoned into Taunton District Court for an arraignment on the criminal charges. The police also suspended Client's LTC.
Attorney Flaherty met with the Client, further investigated the case and researched the applicable law. Attorney Flaherty drafted and argued a Motion to Dismiss on the grounds that the Client was never afforded a clerk's magistrate hearing prior to the scheduled arraignment. The Judge agreed and dismissed the complaint prior to the arraignment.
After the case was dismissed, Attorney Flaherty worked with the police department licensing officer and was able to get the Client's LTC re-instated.

Attorney Dave Flaherty was born and raised in Quincy Massachusetts., where he continues to operate his law practice. He is a 1989 graduate of Boston College High School and 1993 graduate of Fairfield University. He then continued his education at New England School of law, which he attended with his two brothers, both of whom are lawyers and Quincy Police Sergeants.
Upon graduation from Law School, David worked at very busy established Law Firm, located in Quincy Center, where he gained experience in handling a variety of cases, including criminal defense, divorce, personal injury and landlord /tenant matters. He also worked as a Hearings Officer at the Massachusetts Division of Employment and Training.
In 2020, David opened the Law Office of David V. Flaherty. He specializes in criminal defense and with assisting clients either applying for or defending against the issuance of restraining orders (209A) and harassment orders.
Dave currently lives in the South Shore with is wife and three children, Charlie, Abby and Emma. In his spare time, he loves golfing.
